Overview
Better Health Technologies, Inc. and its subsidiaries, including Better Health Supplies, Inc. (“Better Health,” “we,” “our,” or “us”), operate the websites located at www.joinbetter.com and related mobile applications, platforms, and services (collectively, the “Platform”).
Your access to and use of the Platform, products, services, software, and content provided through the Platform (collectively, the “Service”) are governed by these Terms and Conditions (“Terms”).
Acceptance of Terms
Your access to and use of the Service is subject to these Terms and all applicable laws and regulations.
We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
Your Relationship With Better Health
Better Health provides a technology enabled platform and related services designed to help users access medical equipment, supplies, care coordination, and related support services.
Better Health may provide services including:
• ordering and fulfillment of medical supplies and equipment
• insurance coordination and documentation support
• care coordination and customer support
• educational or health coaching services
• digital tools for managing prescriptions, orders, and benefits
Better Health itself is not your treating healthcare provider unless explicitly stated as part of licensed services provided by a licensed professional.
Eligibility
To use the Service you must:
• be at least 18 years old
• reside in a location where the Service is offered
• provide accurate registration information
• comply with applicable laws
Services may vary by state due to regulatory requirements.
Financial Responsibility
You agree that you are financially responsible for any products or services you receive that are not paid for by insurance or another third party.
Insurance verification is only an estimate and not a guarantee of payment.
You remain responsible for any deductibles, copayments, coinsurance, noncovered items, upgrade charges, or denied claims to the extent permitted by law.
Prescription Products
Certain products require a valid prescription from a licensed healthcare provider.
Better Health will only dispense prescription required products when appropriate prescriptions and documentation are obtained.
Account Registration and Security
You must create an account to use certain features of the Service.
You agree to maintain accurate account information, protect your login credentials, and notify Better Health of unauthorized access.
We use industry standard security protections including encryption in transit using TLS or similar technologies.
Privacy and Protected Health Information
Better Health respects the privacy of your personal information.
Our collection and use of personal information is governed by our Privacy Policy.
Some information you provide may qualify as Protected Health Information (PHI) under applicable laws including HIPAA.
When Better Health acts as a Business Associate under HIPAA, we will handle PHI in accordance with applicable legal requirements.
AI Assisted Services and Communications
Better Health may use automated technologies including artificial intelligence, machine learning, chatbots, or automated systems to assist with operational activities.
These technologies may support customer support, eligibility checks, order updates, scheduling, documentation workflows, and general informational responses.
Some communications may occur with AI assisted agents rather than human representatives.
AI systems are designed to support service delivery but may occasionally produce inaccurate or incomplete responses.
AI tools do not replace licensed clinical judgment.
You may request to communicate with a human representative where available.
Communications Consent
By providing your phone number or email address, you consent to receive communications from Better Health regarding your account, orders, documentation requests, billing matters, care coordination, and marketing.
Communications may be delivered through phone calls, text messages, email, or platform notifications.
Where permitted by law, communications may be made using automated dialing systems, prerecorded voice technology, or AI generated voice systems.
Such communications may be delivered by Better Health or its authorized partners.
Communications may be monitored or recorded for quality assurance, training, compliance, and operational purposes.
You understand that your consent to receive communications is not a condition of receiving services.
You may revoke consent to certain communications at any time by replying STOP to text messages or contacting support@joinbetter.com.

Duty to Provide Accurate Information
You agree to provide accurate, truthful, and complete information when using the Service.
Providing inaccurate information may result in delays, denial of services, or account suspension.
Acceptable Use
You agree not to use the Service for unlawful or abusive purposes.
Prohibited activities include hacking or unauthorized access, impersonation, distributing malware, scraping data, or violating applicable laws.
Ownership of the Service
All content, software, and materials associated with the Service are owned by Better Health or its licensors and protected by intellectual property laws.
You are granted a limited, non transferable license to use the Service for personal purposes.
Feedback and Submissions
If you provide feedback or suggestions about the Service, you grant Better Health the right to use such feedback to improve the Service.
This does not apply to protected health information or personal data governed by our Privacy Policy.
Third Party Services
The Service may include links to third party services or products.
Better Health is not responsible for third party services and transactions with those providers are solely between you and the third party.
Partner Services and Care Coordination
Better Health may coordinate with partner organizations including healthcare providers, telehealth providers, pharmacies, insurers, and medical equipment suppliers to support your care and product fulfillment.
Telehealth and Virtual Care Consent
Some services may involve telehealth interactions using telecommunications technologies such as video visits, messaging, or phone consultations.
Telehealth services may be affected by connectivity limitations or technical issues.
Healthcare providers delivering telehealth services remain responsible for clinical decisions.
You may withdraw telehealth consent at any time.
Insurance Authorization and Assignment of Benefits
If you use insurance benefits, you authorize Better Health to verify coverage, obtain prior authorizations, submit claims, communicate with insurers, and appeal claim denials.
You authorize insurers to pay benefits directly to Better Health when permitted.
You remain responsible for any patient responsibility amounts.
Provider Discretion and Product Substitution
Better Health may recommend or substitute medical equipment or supplies when appropriate based on prescription requirements, payer coverage rules, or product availability.
Substitutions are intended to ensure timely fulfillment and coverage.
Terms of Sale
Product availability, pricing, and taxes may change.
Orders may be limited or cancelled if errors occur.
Shipping timelines are estimates and not guaranteed.
Proof of Delivery and Shipment Confirmation
Better Health may maintain proof of delivery documentation for medical equipment and supplies.
Documentation may include carrier tracking records, delivery confirmations, signatures, or photographs.
This documentation may be shared with insurers or regulatory authorities for reimbursement or compliance purposes.
Disclaimers
THE SERVICE IS PROVIDED “AS IS.”
BETTER HEALTH DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability
BETTER HEALTH IS NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.
TOTAL LIABILITY WILL NOT EXCEED $100.
Indemnification
You agree to indemnify Better Health for claims arising from misuse of the Service or violation of these Terms.
Arbitration and Dispute Resolution
Disputes will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
Class actions are not permitted.
You may opt out of arbitration within 30 days by sending written notice to:

Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
To the extent any dispute is not subject to arbitration, such dispute shall be resolved in the state or federal courts located in California.
